phnx photos is meant to be a fun place for people to share their photos quickly and easily. Therefore there are a few rules in place for those who wish to use this service.

Terms of Service

• You may not upload any content that is copyrighted, harassing, or pornographic (including any image containing or suggesting nudity). Doing so will result in an immediate, permanent ban. We will report any illegal content to the authorities if necessary.
• Uploading spam materials is prohibited (any materials soliciting commercial services or endeavors will be considered spam).
• Abusing the service to hotlink website elements (backgrounds, textures, gradients, etc).
• Breaching the service's security or reliability, including reverse engineering, denial of service, or other means of trespass will result in an immediate ban and all incidents will be reported to the authorities.
• phnx photos and David Strack are not responsible for the content of uploaded files, nor does the presence of a file or its content imply endorsement or affiliation.

Privacy Policy

Information provided by the user is held private, and personally identifiable data is not shared with any third party, except in the case of violation of the Terms of Service, a subpoena, or if the user has committed an unlawful act.

The service does collect non-personal information related to demographics and traffic analysis. Non-personal demographic information may also be shared with advertising partners.

Limitation of Liability

Use of phnx services are at the user's own risk. If a user is not satisfied with the service in any way, the only solution is to discontinue use of the service. The service is provided "as-is", without expressed or implied warranties or guarantees. The service makes no claims to data persistence or reliability.

Copyright Infringement Claims

Report any incidents of copyright infringement by clicking the "Report Image" link on the photo's individual page. Provide an email address and details so we can follow up with the claim.

Indemnity

User agrees to indemnify and hold David Strack harmless from any liability, loss, damages, claims, and expenses, (including attorney fees), arising from the use of any feature of the service, including loss of data. This includes the user's responsibility for any and all liabilities arising from the infringement or violation of copyrights or intellectual property. The user also assumes responsibility for any unlawful or defamatory material contained within the user's uploaded content.
